INSTALLING, COPYING, OR OTHERWISE USING THIS PRODUCT INDICATES YOUR ACKNOWLEDGMENT THAT YOU HAVE READ THIS LICENSE AND AGREE TO ITS TERMS. A. LICENSE: The CIRI Human Rights Dataset Project ("CIRI," "we," or "us") provides the Licensee ("You" or "Licensee") with an electronic dataset which may also include "online" or electronic documentation, License (the "License"), and other electronic and/or printed materials (together called the "Product") and the CIRI Human Rights Dataset Principal Investigators (the "Principal Investigators") grant You a license to use the Product in accordance with the terms of this License. The copyright and all other rights to the Product shall remain with us. You must include proper notice of the copyright for the Product on any copies You make and with any secondary products You create based in whole or in part on your use of the Product. The subsequent publication of materials by You that contain information derived from the Product will be properly referenced and cited in notes and/or bibliographies in accordance with the following information, the form of which may be altered to conform with the style of the publication but must contain the essential information as listed: Dataset Name: The Cingranelli-Richards (CIRI) Human Rights Dataset Principal Investigators: David L. Cingranelli and David L. Richards Current Version Copyright: 2013 Dataset Version: 2013.04.30 URL: http://www.humanrightsdata.org. B. RESPONSIBILITIES OF THE LICENSING ENTITY: 1. CIRI will maintain a master copy of the Product and this will be the official, Principal Investigators-authorized copy of the Product. Procedures for making changes in the Product are strictly defined by the authority of the Principal Investigators. Questions of authenticity will be decided by reference to the master copy. New issues of the Product will be authorized by the Principal Investigators. Substantive problems discovered in the dataset may lead the Principal Investigators to order an immediate reissue of the (corrected) Product. 2. CIRI will be responsible for serving prompt electronic notice of all CIRI data updates and revisions, including in the event of substantive problems discovered in the licensed dataset (along with the proposed and/or acted-upon remedies). Such notices will be posted on the CIRI website located at the following URL: http://www.humanrightsdata.org. 3. PRIVACY STATEMENT: CIRI collects registration information to provide usage data to current and potential sponsors. These sponsors help keep CIRI data free for non-commercial users. Neither the Principal Investigators nor the CIRI Staff will use the registration information for anything other than Product notices as described above, nor will the registration information be sold to or shared with any Third Parties. 3. From time to time, minor errors may be discovered in the dataset. The CIRI Human Rights Dataset Principal Investigators will post information on errors located in, and corrections made to, the dataset on the CIRI website. No notification will be made of such corrections deemed non-substantive by the CIRI Principal Investigators. C. RESPONSIBILITIES OF THE LICENSEE: 1. As Licensee, You agree to comply with all provisions stated in this licensing agreement (including Sections D and E below). 2. You agree not to provide copies of the Product to any Third Party (defined as an entity which is neither CIRI nor the Licensee). 3. You agree to use the Product, in whole or in part, exclusively for not-for-profit purposes (including the use by governmental and intergovernmental agencies, as well as by non-governmental organizations). Regarding United States Government usage, see below, Section I, "Restricted Rights." 4. You agree not to include the Product, in whole or in part, in any dataset or datafile, electronic or otherwise, to be sold or licensed to any Third Party. Licensing and/or permission to use the CIRI Human Rights Dataset, in whole or in part, for for-profit purposes must first be obtained by contacting the CIRI Principal Investigators at info@humanrightsdata.org 5. You agree not to use the Product, in whole or in part, for any report, research, analysis, or the like, which itself or the results of which will be sold or licensed to any Third Party. Licensing and/or permission to use the CIRI Human Rights Dataset, in whole or in part, for for-profit purposes must first be obtained by contacting the CIRI Principal Investigators at info@humanrightsdata.org 6. You agree to notify the CIRI Human Rights Dataset Principal Investigators and provide full citation information and/or website linkages for all materials published by You and others utilizing the Product for which You are the registered and licensed user. You grant the CIRI Human Rights Dataset proper permission to post all such citations and website linkages on the CIRI website and to disseminate that information to the CIRI community of users. 7. This licensure agreement may be modified at some future time. You agree to be bound by the licensing provisions as exist (and as posted at http://www.humanrightsdata.org) at the time of use of the Product by Licensee, not as existed at the time of initial licensure. D. YOU MAY: 1. Install and use a copy of the Product on each computer, or network, within your office and home and under your direct supervision and for which You are willing to assume responsibility. Herein, "office" refers to that location and enterprise over which You have professional authority and for which You will serve as registrant, licensee, and contact person for future correspondence with the CIRI Human Rights Dataset Project. 2. Make one copy of the Product for office archive or personal backup purposes. 3. Translate the data into another spreadsheet or statistical software format; this licensing agreement will extend its coverage, as well as the original copyright, to all such translations of the dataset. 4. Decompile, reconstruct, or copy individual variables or set of values to other data compilations; all information derived from the original, copyrighted dataset retains full copyright protection and proper notice of the original copyright must be included with all secondary applications, including data compilations, translations, and publications. See also non-commercial use agreement above in Section C4. E. YOU MAY NOT: 1. Use the Product or make copies of it except as permitted in this License. 2. Rent, lease, assign, or transfer the Product except by explicit written permission from CIRI. 3. Modify or alter the Product, including individual data values, in any way without written notice, acknowledgment, and specification of the alteration(s) in all subsequent products or publications. 4. Use or make reference to the Product as it is related to identifiable individuals or entities in a manner which suggests their association with or endorsement of any product or service. F. TERM: This License shall continue for as long as You use the Product. However, it will terminate if You fail to comply with any of its terms or conditions. You must agree, upon termination, to destroy all copies of the Product. The Limitations of Warranties and Liability set out below shall continue in force even after any termination. G. WARRANTY: WE MAKE NO WARRANTY, EITHER EXPRESSED OR IMPLIED, THAT THE PRODUCT WILL BE FREE FROM DEFECT IN MATERIALS AND WORKMANSHIP. THE DATASET CONTAINS INFORMATION COLLECTED AND COMPILED FROM THE RESEARCH AND PROFESSIONAL JUDGMENT OF THE CIRI HUMAN RIGHTS DATASET RESEARCH STAFF. THE CIRI HUMAN RIGHTS DATASET STAFF HAS DONE EVERYTHING WITHIN REASON TO ASSURE THE ACCURACY, CONSISTENCY, AND RELIABILITY OF THE DATA; WE ASSUME FULL RESPONSIBILITY FOR THE CONTENT THEREIN. H. LIMITATION OF WARRANTIES AND LIABILITY: THE PRODUCT IS PROVIDED ON AN "AS IS" BASIS, WITHOUT ANY OTHER WARRANTIES OR CONDITIONS, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABLE QUALITY, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OR THOSE ARISING BY LAW, STATUTE, USAGE OF TRADE, OR COURSE OF DEALING. THE ENTIRE RISK AS TO THE RESULTS AND PERFORMANCE OF THE PRODUCT IS ASSUMED BY YOU. NEITHER WE NOR OUR DEALERS OR SUPPLIERS SHALL HAVE ANY LIABILITY TO YOU OR ANY OTHER PERSON OR ENTITY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, BUT NOT LIMITED TO, LOSS OF REVENUE OR PROFIT, LOST OR DAMAGED DATA OR OTHER COMMERCIAL OR ECONOMIC LOSS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR THEY ARE FORESEEABLE. WE ARE ALSO NOT RESPONSIBLE FOR CLAIMS BY A THIRD PARTY. OUR MAXIMUM AGGREGATE LIABILITY TO YOU AND THAT OF OUR DEALERS AND SUPPLIERS SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE PRODUCT. THE LIMITATIONS IN THIS SECTION SHALL APPLY WHETHER OR NOT THE ALLEGED BREACH OR DEFAULT IS A BREACH OF A FUNDAMENTAL CONDITION OR TERM OR A FUNDAMENTAL BREACH. SOME STATES/COUNTRIES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU. I. RESTRICTED RIGHTS: If this Product is acquired by or for the U.S. Government, then it is provided with Restricted Rights. Use, duplication, or disclosure by the U.S. Government is subject to restrictions as set forth in subparagraph (c)(1)(ii) of The Rights in Technical Data and Computer Software clause at DFARS 252.227-7013, or subparagraphs (c)(1) and (2) of the Commercial Computer Software - Restricted Rights at 48 CFR 52.227-19, or clause 18-52.227-86(d) of the NASA Supplement to the FAR, as applicable. The contractor/manufacturer is the CIRI Human Rights Dataset Principal Investigators. J. GENERAL: This License is the entire agreement between us, superseding any other agreement or discussions, oral or written, and may not be changed by the Licensee except by a signed agreement with CIRI. This License shall be governed by and construed in accordance with the laws of the United States of America. If any provision of this License is declared by a Court of competent jurisdiction to be invalid, illegal, or unenforceable, such a provision shall be severed from the License and the other provisions shall remain in full force and effect. The parties have requested that this Agreement and all documents contemplated hereby be drawn up in English.
